The petitioner has prayed for bail in a case registered for the offence punishable under sections 354, 504, 506/34 of the Indian Penal Code and sections 7 of the POCSO Act. As per allegation in the FIR, petitioner has attempted to commit wrong with the minor daughter (7 years) of the informant.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner and victim are cousin. A dispute for family partition was going on and only with a view to put pressure, informant has lodged a false case with concocted story against the petitioner. Date and

Patna High Court CR. MISC. No.58688 of 2022(5) dt.19-06-2023 2/2 time of occurrence is not mentioned in the body of the FIR, which falsify the prosecution story. Petitioner has got no criminal antecedent and he is languishing in judicial custody since 8.7.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 7th cum-Special Judge (POCSO) West Champaran, Bettiah in connection with Ramnagar P.S. Case No. 331 of 2022.
