Though this writ petition was filed on 4th January, 2016 after serving a copy of B.N. Mandal University on 22.12.2015 but no counter affidavit has been filed as yet on behalf of the university, however, a counter affidavit has been filed on behalf of the respondent no.1.

It is contended that the husband of the petitioner died in harness on 12.02.2013 while working as a Demonstrator in the department of Psychology in Sarvnarayan Singh Ramkumar Singh

Patna High Court CWJC No.92 of 2016 dt.17-05-2016 2/2 College, Saharsa, a constituent unit of B.N. Mandal University, Lalu Nagar, Madhepura but only provisional family pension is being paid to the petitioner since March, 2014 and P.F. amount has been paid, however, other death cum retiral dues have not been paid till date. Accordingly, I direct the respondent no.4- Registrar, B.N. Mandal University, Lalu Nagar, Madhepura to calculate admissible death cum post retiral dues to the husband of the petitioner and make payment of those dues along with statutory interest, if any, within a period of three months from the date of receipt/ production of a copy of this order, failing which, the petitioner would be entitled for simple interest on the unpaid admissible amount to be calculated from the date on which the same became due till the date of its final payment. Let the necessary calculation done by the university be supplied to the petitioner.

This disposes of the writ petition.
