Petitioners apprehend arrest in a case registered for the offence punishable under Section 30(a)/36 and other allied sections of the Bihar Prohibition and Excise Act, 2018. Prosecution case is that 80 litres country made liquor has been recovered from house of the co-accused Pramod Kumar.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner and he is no way

Patna High Court CR. MISC. No.59012 of 2022(2) dt.02-12-2022 2/2 connected with the aforesaid recovery. Petitioners have got no criminal antecedent.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna City in connection with Didarganj P.S. Case NO. 196 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
