The petitioners apprehend their arrest in a case registered for offences punishable under Sections 406, 420, 467, 468, 471 and 120(B) of the Indian Penal Code. It is contended on behalf of the petitioners that though there is allegation that they have produced fake TE.T. certificate for getting appointment as teacher but, in fact, they were never appointed. It is further contended that even the persons who had obtained appointment on the basis of fake certificate were given opportunity by a Division Bench of this Court to resign from their respective job and, thereafter, it was assured that they

Patna High Court Cr.Misc. No.31697 of 2016 (2) dt.05-09-2016 2 / 2 would not be prosecuted in criminal matter. It is further contended that other co-accused persons have already been granted anticipatory bail by the court below itself.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Randhir Kumar Mehta and Shyam Kishore be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Birpur P.S. Case No. 59 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Birpur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
