ANJANA MISHRA ORAL ORDER 05-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 12.07.2019 in connection with Ahiyapur P.S. Case No.824 of 2019 registered for the offence under Sections 30(a), 34, 36, 38 and 41 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the alleged recoveries were from the hut and not from the conscious possession of the petitioner. It is further submitted that the petitioner has clean antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand)
