JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

The prosecution case is that the informant was surrounded by the accused persons and his bicycle, mobile and cash of Rs. 500/- were snatched. The F.I.R was lodged against unknown. During investigation the name of the petitioners surfaced on the confession of the co-accused. It is submitted by learned counsel for the petitioners that except confessional statement of the coaccused, there is nothing on record to suggest the complicity of the petitioners.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

No.3248 of 2016 (2) dt.20-01-2016 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender within a period of six weeks in connection with Parbatta P.S. Case No. 41 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Khagaria. With the observations above, the application stands disposed off.
