The petitioner is in custody since 25.06.2019 in connection with Ekangarsarai P.S. Case No.154/2019 registered for the offence punishable under Sections 341, 323, 324, 354, 307, 379, 504 of the IPC.

Learned counsel for the petitioner submits that there is case and counter case between the parties on some previous dispute and the petitioner has also received injury. Learned counsel for the petitioner further submits that the allegation of theft of chain worth Rs.50,000/- has only been levelled so as to make the charge graver.

Considering the nature of allegations that there was altercation and the dispute arose since some water had been left open by the neighbour of the petitioner which was being resisted

Patna High Court CR. MISC. No.55666 of 2019(2) dt.18-09-2019 2/2 by him and that the injury has been found to be simple in nature, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Ekangarsarai P.S. Case No.154/2019.
