The petitioner apprehends his arrest in a case filed under Sections 341, 323, 325, 307, 34 of the Indian Penal Code and Section 3/4/5 of the Dayin Prohibited Act. It is contended that allegation of assault by kulhari (Axe) upon the informant has been attributed to the petitioner but the injury report shows that the injury is of lacerated wound which is simple in nature and other injuries have been attributed to other co-accused persons.

Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Muffasil P.S. Case No.183/2015, the above

No.1244 of 2016 (2) dt.22-01-2016 2 / 2 named petitioner, Vinod Mistry shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
