JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Islampur P.S. Case No. 20 of 2013 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.
Petitioner happens to be husband of the deceased and allegation against him is of causing her death with respect to non-fulfilment of dowry.
Submission of learned counsel for the petitioner is that in this case after investigation police has submitted final form against the petitioner and others as deceased died due to snake bite, which will appear from Annexure-2, the report of Doctor.
Heard learned APP also.
In view of above facts and circumstances, let
Patna High Court CR. MISC. No.56078 of 2019(3) dt.01-10-2019 2/2 petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Hilsa, Nalanda, in connection with Islampur P.S. Case No. 20 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
