The petitioner is accused in connection with Barauni (F.C.I) P.S. Case No. 60 of 2015, registered under Sections 385, 386 and 387/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that at the time of making the demand of ransom from the informant Devendra Singh his nephew Chandan Kumar was also present and both of them have claimed to identify the miscreants on seeing them again. After 40 days of the occurrence, Chandan Singh disclosed the name of this petitioner saying that this petitioner was also one of the miscreants in making the demand
Patna High Court Cr.Misc. No.2452 of 2016 (3) dt.16-03-2016 2/2 of ransom, but the name of this petitioner has not been disclosed in the F.I.R., while the occurrence is said to be happened in his presence. Further submission is that the petitioner has not been put on T.I.P for identification by the informant, while he is in custody since 18.05.2015. Further submission is that, in fact, the petitioner is accused in 13 other cases, but he is on bail in all the cases and due to that reason, Police has got implicated this petitioner in this case. The petitioner is in custody since 18.05.2015.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in connection with Barauni (F.C.I.) P.S. Case No. 60 of 2015. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
