JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 413, 414, 419, 420, 467, 468, 471, 472, 379, 120-B of the Indian Penal Code and 66 of Information Technology Act.

Petitioner along with four other persons was caught by the police on suspicion and five ATM cards and some cash were recovered from possession of the petitioner whereas several other ATM cards and cash were recovered from possession of other apprehended persons.

Submission on behalf of the petitioner is that other apprehended persons have already been granted privilege of bail

Patna High Court CR. MISC. No.55095 of 2019(3) dt.27-11-2019 2/2 by different Benches of this court whereas petitioner is in jail custody since 22.05.2019 without having any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Majhaulia P.S. Case No. 228 of 2019.
