JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-02-2019 This is an application for grant of anticipatory bail in connection with Hajipur Sadar P.S. Case No. 648 of 2017, disclosing offences under Sections 363, 366, 494, 498 of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the daughter-in-law of the informant.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and later on, this case has been compromised, which will appear from Annexure3. Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner stating that the direct allegation of kidnapping is against the petitioner and the impugned order shows that the witnesses have also supported
Patna High Court Cr.Misc. No.5690 of 2019(2) dt.01-02-2019 2/2 the prosecution case in para 17 of the case diary. Having heard both sides, considering the above facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on the basis of materials available on record, without being prejudice by order of this Court.
Accordingly, this application is dismissed.
