Diary in the present case was called for, which has since been received.
The petitioner is in custody since 30.09.2015 in connection with Pakaribarwa P.S. Case No. 175 of 2015 registered for offences punishable under Section 396 of Indian Penal Code. Considering the fact that the petitioner was identified by the wife (informant) of the deceased who has clearly stated that there was some dispute between the petitioner and her husband with regard to money transaction and also that she was present at the place of occurrence, I am not inclined to grant the benefit of regular bail to the petitioner, which is accordingly rejected.
