Patna High Court Cr. WJC No.705 of 2013 dt.26-03-2015 2/2 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is informant of Muzaffarpur Sadar P.S.Case No.195 of 2013 dated 10.06.2013 registered under sections 420, 467, 468 and 471 of the Indian Penal Code. The grievance of the petitioner is that respondent no.17 has been appointed on compassionate ground in collusion with the functionaries of the State Government and because of it the State exchequer has been put at loss. It has been contended by the petitioner that the case is under investigation but no step in respect of removal of respondent no.17 has been taken so far. The police are sitting tight over the matter and the investigation is not being brought to its logical end. He seeks a direction from this Court to be issued against the concerned respondents to discharge their public duty with due diligence. In my view, the application is misconceived.
The case is under investigation. The informant of the case has to wait till the police submit their report and in case of any grievance in respect of investigation, he may highlight the same before the Magistrate concerned at appropriate stage in accordance with law.. The application, being devoid of any merit, is dismissed.
