2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 274 & 275 of the BNS and under Sections 30(a) and 45 of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. The case of the prosecution is that from the bank of a river, altogether 50 liters country made liquor was recovered. Locals have disclosed the name of this petitioner as the person who has fled away seeing the appellant.
4. Learned counsel for the petitioner has submitted that the petitioner is quite innocent and has falsely been implicated in this case. Learned counsel has further submitted that nothing has been recovered from the possession of this
Patna High Court CR. MISC. No.65185 of 2025(2) dt.23-09-2025 2/2 petitioner. Learned counsel has also submitted that the petitioner has been framed in this case as he has criminal antecedents. Learned counsel has further stated that the petitioner is in judicial custody since 27.07.2025.
5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner and submitted that the petitioner is having criminal antecedents of five cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail with a condition that the petitioner shall not indulge in similar nature of offences in future. The above named petitioner is directed to be released on bail in connection with Banjariya P.S. Case No. 158 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court of Exclusive Special Excise Court no.01, East Champaran at Motihari.
