1. Heard learned counsel for the parties.
2. The petitioners have preferred this application for grant of anticipatory bail apprehending their arrest in connection with Parasbigha P.S. Case no.121 of 2025 registered under sections 109(1), 126(2), 115(2), 303(2), 74, 352, 351(2), 351(3), 191(2) and 190 of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the informant states that seven named accused persons including the three petitioners herein came variously armed and started to hurl abuses. It is further stated that on the orders of petitioner no.1, Manish Kumar struck the informant with an iron rod causing serious injuries. The other members of the family of the informant were

Learned Senior counsel for the petitioner submits that from the contents of the F.I.R itself it would transpire that the parties are agnates/members of family and the petitioners have been falsely implicated in the case because of property dispute between them. Even from the contents of the F.I.R. it would transpire that the allegation of specific overt act is solely against Manish Kumar while no overt act has been alleged against the petitioners. Petitioner no.1 is only said to be an order giver. The petitioners undertake to cooperate in the investigation/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioners in the F.I.R., the relationship between the parties and the specific overt act being against co-accused Manish Kumar and not on the petitioners herein, it is directed that all the three petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Parasbigha P.S. Case no.121 of 2025 on each of them furnishing bail bond of
Patna High Court CR. MISC. No. 58058 of 2025(2) dt.30-08-2025 3/3 Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Jehanabad.
