Mr.Arun Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 03-07-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Kamtaul P.S. Case No. 169/2017, instituted for offences under Section(s) 376 and 506 of the Indian Penal Code read with Section 3⁄4 of POCSO Act. It is alleged in the written report that the petitioner established physical relationship with the daughter of informant while she was alone in house, on the pretext of performing marriage. The petitioner continued to establish physical relation with the daughter of informant for six months due to which she became pregnant. It is alleged that petitioner told the informant to go to Hyderabad where he will perform marriage. The informant along with her daughter went to Hyderabad but petitioner did not come there.

Patna High Court CR. MISC. No.6721 of 2019(6) dt.03-07-2019 2/2 The victim has given statement under Section 164 Cr.P.C., wherein she has stated that she had gone with this petitioner to Hyderabad but he left her there and returned to Darbhanga.

It appears that petitioner has established physical relationship with victim for about six months with her consent. Petitioner is in custody since 14.05.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessions Judge-cum-Special Judge (POCSO Act), Darbhanga, in connection with Kamtaul P.S. Case No. 169/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
