JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-08-2019 Learned counsel for the petitioner is permitted to implead the Incharge Headmaster of the school in question as party respondent No. 5 during the course of the day. The main issue involved in the instant case is inter se seniority between the petitioner and respondent No. 5 and posting of Incharge Headmaster in the school. There is no regular post of Incharge Headmaster. It is only stop gap arrangement and usually senior most teachers are posted as Incharge Headmaster.

Considering the issue involved in the instant writ

Patna High Court CWJC No.17226 of 2019(2) dt.23-08-2019 2/2 petition, the District Education Officer, Saharsa is directed to hear the petitioner as well as respondent no. 5 and determine their inter se seniority within a period of one month from today and thereafter he shall take step for posting of senior most teacher as Incharge Headmaster of the school in question until regular headmaster is posted. The entire exercise must be completed within a period of sixty days from the date of receipt/production of a copy of this order.
