Following relief has been sought for in the present writ application on behalf of the petitioner:

(i) For issuance of writ in the nature of mandamus for direction to the respondents to consider case of the petitioner for appointment as Panchayat Teacher against the vacancy 2005 of Panchayat Shiksha Mitra, whenever he filed application for

Patna High Court CWJC No.9306 of 2017 (3) dt.09-08-2018 appointment of Shiksha Mitra in the year 2005 and his name running in the merit list and has better qualification to others applicants but respondents did not consider for appointment without any cause and reason and further issued direction to respondent consider the case of petitioner for appointment as Panchayat Teacher as he deemed to be appointment as Shikcha Mitra in the year 2005 on the ground lesser qualified applicants have been appointed Shikcha Mitra in the year 2005 left the case of petitioner, when he has better qualification to others and further give other legal consequential benefit to petitioner.

Considering the facts and circumstances of the case, the petitioner is directed to prefer a statutory appeal before the District Appellate Authority, East Champaran, Motihari within a period of thirty days from the date of receipt/production of copy of this order and the same shall be disposed of by the District Appellate Authority, East Champaran, Motihari within the statutory period, in accordance with law.

Patna High Court CWJC No.9306 of 2017 (3) dt.09-08-2018 With the aforesaid observation/direction, the present writ application stands disposed of.
