ANJANA MISHRA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kotwali P.S. Case No.156 of 2019 for allegedly having committed the offence under Sections 498A, 364/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that the allegation against the present petitioner is false and mischievous and he has no role to play in the occurrence. It is further submitted that save and except his name taken in the F.I.R., there is no material in the case diary to indicate that the petitioner was in any way involved in the occurrence. Learned counsel for the petitioner further submits that the

Considering the aforementioned facts and circumstances and that there being no cogent material in the case diary to support the allegations as made in the F.I.R., let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S. Case No.156 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
