Petitioner seeks regular bail in connection with Buxar (Ind.) PS Case No. 199 of 2021 registered for the offence under Sections 25 (1-b)a / 26 / 35 / 27 of the Arms Act. Two live cartridges and one smart phone are said to have been recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner has falsely been implicated by Police with oblique motive and at the time search and seizure procedures prescribed under the Cr.P.C. have not been followed. Insofar as criminal antecedent of the petitioner is concerned, learned counsel submits that in all the five cases the petitioner has been acquitted. The petitioner is in custody since 11-10-2021 and charge sheet has already been submitted.

No.70044 of 2021(2) dt.24-05-2022 2/2 Regard being had to the submissions made by the parties, taking into consideration the material available on record, the fact that petitioner is in custody since 11/ 10 / 2021 , charge sheet has already been submitted and there is no likelihood that petitioner will abscond or tamper with the evidence, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand ) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Buxar ( Ind.) PS Case No. 199 of 2021.
