JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date: 29-11-2017 Heard counsel for the petitioner and the State. While respondent no.7 was pursuing her remedy against her termination the instant petitioner was appointed in her place. Finally, vide order dated 13.5.2013, passed in C.W.J.C.No. 8162 of 2013 filed by respondent no.7, a direction was issued to the Collector, Gaya to dispose of the appeal filed by respondent no. 7 against her termination. Pursuant to the order passed therein and in compliance of order, passed by this Court on 13.5.2013 in C.W.J.C.No. 8162 of 2013 and analogous cases cancellation of appointment of respondent no.

7 has been set aside and she has been asked to perform the duties of the Anganbari Sahaika of Center 134. The said impugned order dated 3.5.2014 (Annexure 1) has been passed in compliance of order passed in appeal before the Collector, Gaya.

Patna High Court CWJC No.10752 of 2014 dt.29-11-2017 appealed the order passed in appeal by the Collector, Gaya or she has taken any remedy against order dated 13.5.2013, passed in C.W.J.C.No. 8162 of 2013 and other analogous cases. In view of the aforesaid position, there appears to be no infirmity in the order dated 3.5.2014, passed by the CDPO, Gaya in compliance of the order, passed in the writ petitions. The writ petition is dismissed.
