JUSTICE RAJIV ROY ORAL ORDER 22-09-2025 Learned counsel for the petitioners pray for and is allowed the implead the Divisional Commissioner, Patna Division, Patna as respondent no.5 in course of the day.
2. Heard the parties.
3. The present petition has been preferred for the grant of following relief(s):
Patna High Court CWJC No.1732 of 2015(5) dt.22-09-2025 2/3 "for issuance of writ of mandamus directing the respondents for payment of compensation alongwith interest over the award of the court to the writ petitioners regarding acquisition of their lands for the construction of storm drainage scheme (Digha Sevarage Nala) at Village Digha No.1 acquired vide Notification Under Section 4(1) and 17(4) dated 21.01.1989 in which Award of the court was passed on 30.12.1989 by Sp; L.A. Judge IV Patna in which two set of cases were decided. The L.A. Case No. 116 of 1995 to 164 of 1995 were for payment of interest over the amounts of interest and from L.A. case No.165 of 1995 to 214 of 1995 are for land value with interest as per Award of the court."
4. Second supplementary counter affidavit has come on behalf of the District Land Acquisition Officer, Patna bringing all the chart to show the payment details.
5. This Court is of the opinion that the necessary steps have been taken by the respondents. Learned counsel for the petitioners at this stage submits that they may be permitted to
Patna High Court CWJC No.1732 of 2015(5) dt.22-09-2025 3/3 file appropriate petition before the Divisional Commissioner, Patna Division, Patna as still they have some grievance relating to the details given by the concerned District Land Acquisition Officer, Patna.
6. Learned State counsel has no objection

In that background, the writ petitions stands disposed of allowing the petitioner to approach the newly added respondent the Divisional Commissioner, Patna Division, Patna and if such fresh petition is preferred in next four weeks, the same shall be considered, all the concerned respondents noticed and the matter has to be taken to its logical conclusion on merit by 31st March, 2026 taking into account the fact that the writ petition was pending before Patna High Court.
8. The writ petition stands disposed of with the aforesaid observation.
