JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-04-2019 After some argument, learned counsel for the petitioner submits that the writ application may be disposed of at this stage giving liberty to the petitioner to file statutory appeal before the District Magistrate, Gaya.
Learned counsel for the State has no objection to the same. This writ application is being disposed of, as prayed for, giving liberty to the petitioner to file a statutory appeal within a period of 30 days from today. If such an appeal is filed before the respondent no. 2 the same shall be considered on merit and in case any question of limitation arises for consideration the same will be considered keeping in mind the petitioner was pursuing his remedy before this court. The appeal so preferred shall be disposed of within the statutory period.
