The petitioner seeks bail in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act and Section 8(c), 21(b), 22(c) of the N.D.P.S. Act. The learned counsel for the petitioner submits that earlier his bail application of the petitioner was rejected by order dated 31.03.2022 in Cr. Misc. No. 63883 of 2021. The Court is not inclined to release the petitioner on bail in nature of the allegation which stands recorded in the order dated 31.03.02022.

However, since the charges stand framed against the petitioner as submitted by the learned counsel for the petitioner.

No.59220 of 2022(2) dt.09-11-2022 2/2 In the event, if the trial is not concluded within a period of nine months from the date of receipt/ production of a copy of this order, then the petitioner shall be at liberty to file his application for bail before the learned trial Court and in the event, if the learned trial Court comes to a conclusion that for no fault of the petitioner the trial could not be concluded he shall be released on bail.

The application stands disposed of.
