The petitioner seeks bail in connection with Barauli P. S. Case No.143 of 2018 registered under Section 394 of the Indian Penal Code.
Learned counsel for the petitioner submitted that the petitioner is neither named in the F.I.R. nor the looted articles have been recovered from his possession nor he has been put on T.I. Parade, even though he is in custody since 28.10.2018.
It is further contended that the co-accused Batak Manjhi having identical allegation to that of the petitioner has already been granted bail vide order dated 14.02.2019 passed in
Patna High Court CR. MISC. No.55558 of 2019(3) dt.27-11-2019 2/2 Cr. Misc. No.7998 of 2019 Learned counsel for the State has opposed the application for grant of bail to the petitioner. He submitted that the petitioner has confessed his guilt before the police and even the confidential information received by the police suggest that the petitioner was actively participated in the occurrence. Be that as it may, in view of the fact that the petitioner is neither named in the F.I.R. nor he put on T. I. Parade, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV, Gopalganj in connection with Barauli P. S. Case No.143 of 2018.
