2. The petitioner is in judicial custody in connection with Complaint Case No. 450(C) of 2020 for the offence punishable under Sections 498A of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.

3. Earlier, the anticipatory bail application of the petitioner was allowed in Cr. Misc. No. 49944 of 2022 on 17.01.2023.

4. It is surprising that the petitioner despite being

No. 79098 of 2023 has been filed with a prayer to extend the period of surrender. The same is deprecable and at first instance, this Court was inclined to reject the petition.

5. Learned counsel for the petitioner submits that due to health issue, he could not surrender in time and he will suffer, if he is sent to jail. He further submits on instruction that he is ready to pay Rs.50,000/- to the opposite party no.2 namely Prerna Kumari by Bank Draft which shall be submitted before the trial Court to be handed over to the opposite party no.2 after her identification irrespective of the outcome of the modification petition is not allowed.

6. Learned APP opposes the prayer stating that he has misused the privilege extended by this Court earlier.

7. Considering the fact that he is serving in a Nationalized Bank, sending him behind the bar will serve no purpose, has on his own decided to pay Rs. 50,000/- to his wife (opposite party no.2), this Court is inclined to extend the period of surrender for next four weeks from today.

8. This modification petition is allowed. The period of surrender is further extended for four weeks from today subject to payment of Rs. 50,000/- through the Demand Draft issued by the local State Bank of India to the lady and the Demand Draft has to be submitted before the Court concerned at the time of furnishing of the bail bond.
