It is for the limited relief that this writ petition is filed. The petitioner complains that Excise Confiscation Case No. 697 of 2017 arising from Excise Case No. 23 of 2017 is being unnecessarily delayed and thus appropriate direction may be issued to the District Magistrate, East Champaran at Motihari for its expeditious disposal.

We find no reasons for there being any opposition to such prayer for if confiscation case has been instituted, it needs disposal.

In the circumstance noted, the Collector-cum-District

Patna High Court CWJC No.1604 of 2019(2) dt.29-01-2019 2/2 Magistrate, East Champaran at Motihari, is directed to consider and dispose of Excise Confiscation Case No. 697 of 2017 arising from Excise Case No. 23 of 2017 in accordance with law and after due opportunity of hearing to the petitioner as well as the Department within a period of three months from the date of receipt/production of a copy of this order.

The writ petition is disposed of with the observation and direction above.
