JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-01-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354, 307 and 504/34 of the Indian Penal Code. Since the specific accusation of assault is against petitioner no.1, Surendra Yadav @ Surendra Yadav, this Court is not inclined to interfere.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks keeping in view of the fact that there is counter version of the occurrence also.

So far as, petitioner no.2 is concerned, since there is no accusation of assault against petitioner no.2, let her be released on anticipatory bail, in the event of arrest or surrender before the

Case No. 56 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
