The petitioner apprehends her arrest in Jehanabad SC/ST P.S. Case No. 96 of 2013, registered for the offences punishable under Sections 436, 337 and 34 of the Indian Penal Code and Section 3(i)(x)/2(v) of the SC/ST (Prevention of Atrocities) Act.

Putul Devi the informant alleged that at about 8.30 in the night she saw her house burning. The house of her sister Guria Devi also got fire. In the light of fire she saw Gohman Yadav, Guddu Bind and Nabab Mian fleeing from there. The informant further alleged that the accused persons used to visit the house of the petitioner.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.4554 of 2015 (2) dt.03-02-2015 name of the petitioner is mentioned in the case on mere suspicion and only because the accused persons who were found fleeing away from the place of occurrence, used to visit the house of the petitioner.

On consideration of the facts that there is no allegation against the petitioner and the petitioner is made accused only because the accused who were alleged to have ignited fire in the house of the informant used to visit in the house of the petitioner, the petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jehanabad in connection with Jehanabad SC/ST P.S. Case No. 96 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
