1. Heard learned counsel for the petitioners, learned APP for the State and the learned counsel appearing on behalf of the informant.
2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 126, 115(2), 109, 85, 208, 352, 351(3), 3(5) of the B.N.S.
3. The learned counsel for the petitioners submits that the petitioner nos.1 and 2 have antecedent of two cases, but
Patna High Court CR. MISC. No.59966 of 2025(2) dt.11-09-2025 2/3 then, both the cases were instituted by the instant informant and petitioner no.3 is a person with clean antecedent. It is next submitted that the informant alleges that earlier she had filed a case against her husband and his family members alleging torture for dowry at Arwal Police Station. Further, on orders of Court, the informant started staying at her matrimonial home and conceived, but pregnancy got aborted on account of assault for which a case was again instituted. It is next alleged that again on orders of Court she came back to her matrimonial home when she was again assaulted by the accused persons and they left thinking she is dead.
4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that petitioner no.1 is own brother of Dhananjay, who is husband of the informant while petitioner no.2 is wife of petitioner no.1 and petitioner no.3 is their daughter. It is next submitted that whenever any dispute arises in between the husband and the wife, the entire family members are implicated in a mechanical manner.
5. Learned A.P.P. as well as the learned counsel appearing on behalf of the informant opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Arwal in connection with Kaler P. S. Case No.48 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
7. The application stands allowed.
