The petitioner seeks bail in Ramgarhwa P.S. Case No.36 of 2013 instituted for the offences under Sections 304B/34, 201/34 and 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that all the witnesses have been examined except the Investigating Officer and on that account the trial court is not in a position to proceed with the matter.
In this view of the matter, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected for the present.
However, the Superintendent of Police, East
Patna High Court Cr.Misc. No.21208 of 2016 (2) dt.19-05-2016 Champaran, Motihari is directed to produce the Investigating Officer without any delay and trial court is directed to take all efforts for the procurement of the witness.
