NILU AGRAWAL ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
By order dated 23.02.2016 passed in Cr. Misc. No. 7990 of 2016, petitioner was allowed anticipatory bail in connection with Jokihat P.S. Case No. 258 of 2015 pending in the Court of learned Sub-Divisional Judicial Magistrate, Araria on her undertaking that she will deposit 20% of the defalcated amount of Rs. 11,82,839 within three months, but she deposited only Rs. One lakh on 22.04.2016, as is evident from Annexure-1 to the supplementary affidavit filed on behalf of the petitioner. By filing the present modification application, petitioner has sought extension of time to deposit the aforesaid amount as also to surrender granted under the said order.
Patna High Court Cr.Misc. No.22392 of 2016 (2) dt.19-05-2016 2/2 In the facts and circumstances of the case, petitioner is directed to deposit rest of the 20% of the defalcated amount of Rs. 11,82,839 within one month from today, failing which the learned Court below will be at liberty to cancel the bail bond of the petitioner. Time to surrender granted vide order dated 23.02.2016 is also extended by eight weeks from today. Order dated 23.02.2016 passed in Cr. Misc. No. 7990 of 2016 is modified to the extent indicated above. This modification application is, accordingly, allowed.
