The learned counsel for the petitioner submits that the present transfer application has been filed seeking transfer of Matrimonial Case No.1353 of 2018 from the Court of the learned Principal Judge, Family Court, Patna to the Court of the learned Principal Judge, Family Court, Rohtas at Sasaram. The learned counsel for the opposite party does not dispute or object to the submissions made by the learned counsel for the petitioner and submits that aforesaid Matrimonial Case No.1353 of 2018 has been filed seeking restitution of conjugal rights and in the event, if the petitioner wants to contest at Sasaram, he has no objection as opposite

Patna High Court MJC No.3363 of 2019(9) dt.08-05-2023 2/2 party is always willing to keep the petitioner with all dignity and honour.

Since the opposite party has not objected to the prayer of transfer made by the petitioner, hence the present Matrimonial Case No.1353 of 2018 is directed to be transferred from the Court of the learned Principal Judge, Family Court, Patna to the Court of the learned Principal Judge, Family Court, Rohtas at Sasaram.

The learned Family Court, Patna on receipt of the order shall immediately transfer the file of Matrimonial Case No.1353 of 2018 to the Court of the learned Principal Judge, Family Court, Rohtas at Sasaram.

The present application is disposed of.
