Petitioner apprehends his arrest in connection with Rajoun P.S.Case No. 39 of 2009 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

At the very outset, learned counsel for the State has submitted that in this case process under Sections 82 and 83 Cr.P.C. has already been exhausted and petitioner has been declared absconder.

Heard both sides.

In such view of the matter, let petitioner surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
