JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 22.09.2018 in connection with Beaure P.S.Case No. 304 of 2017 registered under sections 328,302,201, 120(B)/34 of the Indian Penal Code.

Petitioner happens to be husband of deceased and according to the prosecution case itself, the informant got knowledge about the ailment of deceased from petitioner and having heard the aforesaid information, the informant came to Patna and lodged the present case. The informant has admitted in his written report that he got information regarding the

Patna High Court CR. MISC. No.2441 of 2019(4) dt.28-03-2019 2/3 admission of deceased at PMCH, Patna, but when he reached at PMCH, Patna, he did not find deceased as well as petitioner. Learned counsel appearing for the petitioner submits that deceased died her ailment and petitioner and others made attempt to save the life of the deceased being brought her to PMCH, Patna but when deceased was brought to PMCH, Patna, she was declared dead and, thereafter, the informant along with his small children and others went to her native place where the dead body of the deceased was cremated. In support of his contention, he referred para- 32, 33 and 34 of the case diary. Moreover, the I.O in course of investigation, verified the above stated fact and at Para- 19 of the case diary, the I.O incorporated that a purcha of registration had been issued in name of deceased Archana Kumari from PMCH, Patna but there was no evidence to show that she was ever admitted in PMCH, Patna.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that investigation against the petitioner has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief
