JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-08-2018 The petitioner has challenged the order dated 11.10.2017 passed in Cr. Appeal No. 78 of 2017 whereby the learned appellate court has affirmed the order dated 04.09.2017 passed by the learned Principal Magistrate, Juvenile Justice Board, Vaishali at Hajipur refusing to release the petitioner from the remand home, who has been made accused in connection with Kartaha P.S. Case No. 32 of 2017 instituted for the offences under Section 376 of the Indian Penal Code and Sections 8 and 12 of the Protection of Children from Sexual Offences Act.

From the order impugned, it appears that the petitioner was more than 16 years of age on the date of the occurrence and is alleged to have raped a minor girl. The aforesaid allegation has been affirmed by the victim

Patna High Court CR. REV. No.1144 of 2017(4) dt.10-08-2018 2/2 in her 164 statement. The social investigation report has also been taken into account by the learned appellate court which reflects that the petitioner is in bad company and is addicted to watching vulgar movies.

He requires to be kept under surveillance.

For the aforesaid reasons, his prayer for being released from the remand home has been refused by the learned Juvenile Justice Board as also by the appellate court.

This Court finds no good reason to interfere with the orders referred to above.

The petition is dismissed.
