The petitioner is in custody since 22.05.2019 in connection with Bhargama P.S. Case No. 24 of 2019 registered for the offence punishable under Sections 341/323/324/325/ 307/379/504/506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is case and counter case between the parties with injuries having been inflicted on both sides. Learned counsel further submits that so far as the present petitioner is concerned, no specific role has been attributed to him and the Lathi blow is said to have been attributed to one Dilip Das and not the petitioner.
Learned counsel for the informant submits that there was a head injury and a fracture as a result of which, the
Patna High Court CR. MISC. No.55477 of 2019(2) dt.18-09-2019 2/2 informant became unconscious and, therefore, the petitioner being one of the members of the crowd is not entitled to the privilege of bail.
Having heard learned counsel for the parties and considering the fact that the petitioner was neither the order given nor was he attributed to any specific role and that he has just been named as the member of the crowd and that he has no criminal antecedent, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Araria, in connection with Bhargama P.S. Case No. 24 of 2019.
