The petitioner is languishing in custody since 25.11.2014 in a case registered for the offences punishable under Sections 341, 385, 387, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that the petitioner demanded extortion of Rs.5,00,000/- for plying tractor in the village and resorted to three rounds of firing but the informant did not receive any injury.

It is submitted by learned counsel for the petitioner that even assuming the accusation no offence under Section 307 of the IPC is made out.

Patna High Court Cr.Misc. No.3077 of 2015 (02) dt.22-01-2015 2/2 Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Matihani P.S. Case No. 173 of 2014. The learned court below will positively cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
