JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 This is an application for grant of anticipatory bail in connection with Jainagar P.S. Case No. 110 of 2014, disclosing offences under Section 302 of the Indian Penal Code. Allegation as per F.I.R. is that on the instruction of Chokidar, the petitioner has taken the deceased by a Bolero vehicle for treatment from Jainagar and later on, the informant came to know that the deceased died and in postmortem report, it appears that the deceased died due to strangulation. Submission of learned counsel for the petitioner is that he is only driver of the said vehicle and bringing the deceased for treatment and he does not know as to how the deceased died. Further submission is that he also informed the informant and others about the death of the deceased. Heard learned A.P.P. also.

Patna High Court CR. MISC. No.4529 of 2019(3) dt.12-03-2019 2/2 Having heard both sides, in view of the facts and circumstances of the case and also the fact that death occurred due to strangulation, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.

Accordingly, this application is dismissed.
