JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-09-2024 The complaint of the petitioner in the present writ petition is that no action is being taken by the Circle Officer, Basantpur, District-Siwan in pursuance to the encroachment proceedings initiated by him vide Encroachment Case No. 08 of 2007-08, hence appropriate directions be issued to the competent authority.

Per contra, the learned counsel for the respondentState submits that in case the aforesaid encroachment

Patna High Court CWJC No.14521 of 2024(2) dt.24-09-2024 2/2 proceedings are still pending, the same would definitely be concluded and in case any order has been passed by the Circle Officer, Basantpur, District-Siwan for removal of the encroachment in question, the same would definitely be executed within a stipulated time frame, as is fixed by this Court.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the District Magistrate, Siwan to ensure that the proceedings of the aforesaid Encroachment Case No. 08 of 2007-08 are brought to its logical conclusion, in accordance with law and after hearing the affected parties, within a period of eight weeks of receipt/production of a copy of this order.

The writ petition stands disposed off on the aforesaid terms.
