2. The petitioner seeks regular bail in connection with Sadar Excise P.S. Case No. 217 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act.
3. On secret information, on conducting raid at the marked place, police party recovered 1620 litres country made liquor and 48 litres Beer from a Pick-up Van in which petitioner was sitting and 48 litres Beer from a motorcycle. Petitioner and two co-accused persons namely Nilesh Kumar and Ram Adhin were apprehended on the spot.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. Petitioner is neither owner of the said vehicle nor the seized liquor belongs to him. It is submitted that petitioner was returning home on the date of occurrence along with his two friends but in the way he was falsely apprehended. Nothing has been recovered from the conscious possession of the petitioner. There is no independent
Patna High Court CR. MISC. No.58140 of 2025(3) dt.15-10-2025 2/2 witness to the seizure-list. Petitioner has no criminal antecedent. He is in custody since 01.07.2025. Charge-sheet has already been submitted in this case. There is no chance of absconding the petitioner or tampering with the evidence. Similarly situated coaccused persons, namely Nilesh Kumar @ Nilesh Kamat and Ram Adhin Kumar Yadav have been granted bail by this Court, vide order dated 17.09.2025 passed in Cr. Misc. No. 59857 of 2025.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Act, Madhubani in connection with Sadar Excise P.S. Case No. 217 of 2025.
