2. The present application has been filed for modification of the order dated 04.10.2024 passed in Cr. Misc. No. 61223 of 2024 by which the petitioner was granted anticipatory bail in connection with Rudrapur P.S. Case No. 20 of 2024 and the petitioner was directed to surrender in the Court below within a period of six weeks from the date of the aforesaid order 04.10.2024.

3. Learned counsel for the petitioner submits that the petitioner being a poor person had gone to Mumbai for earning his livelihood after filing of the anticipatory bail bearing Cr. Misc. No. 61223 of 2024. He further submits that the petitioner

No.63232 of 2025(2) dt.12-09-2025 2/2 reached at his village on 3rd of August, 2025 and, thereafter, went to the learned court below on 04.08.2024 when he learnt regarding the order dated 04.10.2024 passed in Cr. Misc. No. 61223 of 2024. It is prayed on behalf of the learned counsel for the petitioner that further time may be extended so that the petitioner could surrender in the Court below.

4. This Court finds that the petitioner was granted privilege of anticipatory bail by this Court vide order dated 04.10.2024 but, the petitioner did not surrender before the learned court within the stipulated time-period prescribed in the aforesaid order dated 04.10.2024.

5. Having heard learned counsel for the parties, this Court does not find sufficient ground for allowing the present modification petition.

6. Accordingly, the present modification petition stands dismissed with a direction to the petitioner to surrender before the court below within a period of six weeks from today and seek regular bail.
