====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner in the present case is seeking anticipatory bail in connection with Kaler P.S. Case No. 26 of 2017 registered for the offences punishable under Sections 406, 420, 409, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR, his name has been transpired on the basis of suspicion in this case whereas the petitioner is authorised owner of the 'Dharma Kanta' at Kaler.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the facts and circumstances of this case,

Patna High Court CR. MISC. No.63623 of 2019(3) dt.20-11-2019 2/2 wherein it has come that this petitioner is owner of Jay Mata Di Mill and the misappropriated rice were also being taken to the mill of this petitioner and his involvement has been revealed in course of investigation in Paragraph 64, 89 and 102 of the case diary. This Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Application is dismissed.

In case, petitioner surrenders in the court below and prays for regular bail within a period of four weeks from today, the same shall be considered on its own merit. (Rajeev Ranjan Prasad, J) vats/ved U T
