JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 20-05-2016 Heard the counsel for the petitioners and the State. Four petitioners belonging to one family seek anticipatory bail in Maharajganj(G.P. Nagar) P.S. Case 185 of 2015 registered under sections 307, 427, 435 and 447 IPC. The allegation is that all the accused persons named in the FIR came to the Bathan of the informant and assaulted the father-in-law as well as the husband of the informant with diverse weapons. The counsel for the petitioners placed the FIR in order to contend that no allegation of causing injury to any of the injured attributed to the petitioner. There is also a counter version of the case (Annexure-4) in which two persons received injury at the

Some of the accused(s) against whom there is some allegation of causing injury, have been granted the privilege of anticipatory bail vide Annexure-3. The petitioners do not carry any criminal antecedents. Considering the above, the petitioners above named, in the event of arrest/surrender within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of CJM, Siwan in Maharajganj(G.P. Nagar) P.S. Case 185 of 2015 on condition that one of the bailors of each of the petitioners shall be their own/close family members. In the event of framing of charge, they shall appear on each date fixed at the trial. Failure in appearance on two consecutive dates shall entail cancellation of their bail bonds.
