JUSTICE SUDHIR SINGH ORAL ORDER 14-05-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 90 C of 2014 for the offence under Sections 420, 406 and 323 of the Indian Penal Code. Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that the petitioner and his wife had taken Rs. 6,45,000/- from the complainant with assurance that they will return the same and in case of failure got registered the land of the value of loan.
It has been submitted on behalf of the petitioner that the petitioner had taken money from the complainant and subsequently has not returned the same and for the same the present prosecution has been brought against him. It has been submitted on behalf of the petitioner that he is ready to deposit an amount of Rs. 20,000/- (twenty thousand) in the court below,
Patna High Court Cr.Misc. No.3715 of 2015 (3) dt.14-05-2015 2/2 which will be subject to result of the case. On behalf of the State, it has been submitted that the petitioner is named in the complaint petition. Considering the fact that the petitioner is ready to deposit an amount of Rs. 20,000/- (twenty thousand) in the court below, which shall be subject to disposal of the case, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of five weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Biharsharif in connection with Complaint Case No. 90 C of 2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
