The petitioners, six in number, apprehend their arrest in Manjhi P.S. Case No. 165/2013 registered under Sections 304B, 201/34 of the Indian Penal Code.
The informant alleged that his sister was married with Imamuddin, son of Hanif Miyan, petitioner no. 1 but, later on, his sister was burnt to death. He further alleged that Imamuddin was living in Mumbai and, at his instance, his sister was killed.
Learned counsel for the petitioners submits that the petitioners are in-laws of the deceased. The deceased was pregnant
Patna High Court Cr.Misc. No.5213 of 2015 (2) dt.06-02-2015 2/2 and she died during the course of her pregnancy. The informant participated in the last rites of the deceased but, later on, he filed a case making omnibus and general allegation.
It appears that the informant did not make any allegation of demand of dowry and torture nor did he make any allegation against the petitioners.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Manjhi P.S. Case No. 165/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
