JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-06-2019 The Consumer Protect Act itself provides a time limit for disposal of the cases filed by the consumers. According to the Act, it is ninety days time within which the Forum has to dispose of the complaint.

The petitioner, in the present case, has moved before this court when his Complaint Case No. 230/2017 has remained pending so far. He has explained in the Writ Application the reasons as to why he is feeling helpless due to pendency of the consumer case so long.

Learned counsel for the Insurance Company (respondent no. 2 - 4) is present and submits that perhaps in

Patna High Court CWJC No.3075 of 2019(2) dt.25-06-2019 2/2 want of adequate infrastructure and absence of adequate number of members in the Forum, the matter has remained pending. Whatever be the reasons for pendency of the complaint case so far, in the facts and circumstances of the case, this court directs the District Consumer Forum, Siwan (Respondent No.1) to consider and dispose of the complaint within a period of 60 days from the date of receipt/production of a copy of this order.

Learned counsel for the Insurance Company has assured this court that he would assist the Forum in early disposal of the case and shall not indulge in seeking any adjournment.

This Writ Application stands allowed.
