The present application has been filed for modification of the order dated 06.12.2018 passed in Cr.Misc.No. 72664 of 2018, by which the petitioners were granted anticipatory bail and the petitioners were directed to surrender and furnish bail bond in the court below within a period of six weeks.
Due to inadvertence, in the order dated 06.12.2018 passed in Cr.Misc.No.72664 of 2018, the designation of the court has wrongly been mentioned as "Addl. Sessions Judge III-
Patna High Court Cr.Misc. No.2691 of 2019(2) dt.15-02-2019 2/3 cum-Spl. Judge, Vaishali at Hajipur", whereas it should have been "Addl. Sessions Judge II-cum-Spl. Judge, Vaishali at Hajipur".
Let in the order dated 06.12.2018 passed in Cr.Misc.No.72664 of 2018, the designation of the court be read as "Addl. Sessions Judge II-cum-Spl. Judge, Vaishali at Hajipur" in place of "Addl. Sessions Judge III-cum-Spl. Judge, Vaishali at Hajipur".
It is submitted on behalf of the counsel for the petitioners that further time may be extended so that the petitioners could surrender and furnish bail bond in the court below Addl. Sessions Judge II-cum-Spl. Judge, Vaishali at Hajipur" in connection with Goraul P.S. case No.292 of 2018. Considering the submissions made on behalf of the learned counsel for the petitioners and the grounds mentioned in the modification application, the period of surrender of the petitioners in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order.
The rest of the conditions stipulated in the order well be same.
The order dated 06.12.2018 passed in Cr.Misc.No.
Patna High Court Cr.Misc. No.2691 of 2019(2) dt.15-02-2019 3/3 72664 of 2018, is modified to the extent as indicated above. The modification application is, accordingly, disposed of.
