====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 02-09-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Paliganj P.S. Case No. 390 of 2024 dated 29.09.2024 registered for the offences punishable under Sections 318(4), 338 and 336(3) of the B.N.S.

3. As per the prosecution case, the informant is the proprietor of office of Himalaya College at Paliganj and he employed the petitioner as a staff in the said college but he misappropriated the money i.e., Rs. 3,20,000/- from nursing students by issuing fake receipts. When the informant went to the house of the petitioner, he abused and threatened him to kill.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is a student of Himalaya College and he has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 09.06.2025.

5. Learned A.P.P. for the State and learned counsels for the informant have vehemently opposed the bail petition of the petitioner. Learned counsel for the informant has further submitted the petitioner to return the said amount i.e. Rs. 3,20,00/- which was taken by the nursing students.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur, Patna in connection with Paliganj P.S. Case No. 390 of 2024, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date,
